20 Year Warranty

If within the twenty (20) year warranty period, after the date of shipment, any Products furnished by Tara Distribution Group, LTD. (TDG) prove to be defective in material or workmanship or fail to produce results consistent with TDG specifications for the application in question, upon examination by TDG, TDG will repair or replace any defective product or supply identical products F.O.B. at TDG's sole discretion. TDG cannot be responsible for inferior materials and other products used previously providing an unsatisfactory surface to warrant product performance. TDG will not be responsible for the cost of removal, installation or re-installation of any Products or items supplied by third parties, where such removal installation or re-installation is required to repair any defective products. Furthermore, TDG will not be responsible for and assumes no liability for the materials or workmanship or any transportation charges, labor costs or other related replacement of defective products, without TDG's prior written consent. This warranty will be voided if (a) the products have not been stored, installed, or maintained or applied in accordance with accepted industrial practice. (b) The products have been subjected to any accident, misapplication, abuse or misuse, (c) Buyer has used, repaired, or modified the products after the discovery of the defect without TDG prior written consent to continue use, (d) Buyer refuses to permit TDG to determine the nature of defect claimed, (e) Buyer uses the product in an application inconsistent with TDG's recommendations.

EXCEPT AS PROVIDED IN THIS WARRANTY, ALL WARRANTIES, UNDERTAKINGS, CONDITIONS OR REPRESENTATIONS (WHETHER INNOCENT OR NEGLECT) INCLUDING WITHOUT LIMITATION THOSE WITH RESPECT TO MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE QUALITY OR DURABILITY, WHETHER EXPRESSED, IMPLIED, STATUTORY ARISING FROM COURSE OF DEALING, USAGE OF THE TRADE OR OTHERWISE RESPECT TO ANY EQUIPMENT ORDER, ARE EXPRESSLY EXCLUDED. NO EXPRESSED OR IMPLIED WARRANTY IS GIVEN AS TO THE CAPACITY, EFFICIENCY OR PERFORMANCE OF ANY EQUIPMENT, EXCEPT AS MAY BE PROVIDED IN A WRITTEN AGREEMENT.
